How to navigate a high asset amicable divorce with my spouse?
Divorce does not have to be an expensive and drawn out process if you and your spouse approach the divorce process on the same page and with a collaborative versus an adversarial approach. You can achieve an amicable solution that protects your legal interest through an uncontested divorce or a collaborative divorce process.
A collaborative divorce process will involve attorneys for both sides, one financial advisor, one counselor, and if necessary a professional who protects the children's best interest, but without the stress of litigation and the court process hanging over your head.
An uncontested divorce in our office requires that you and the other party have an agreement regarding all issues before retaining our office, and this process will not require mediation or court intervention. After the statutory 60 day waiting period expires, the final documents are submitted to the court for review and signature.
Regardless of which option you move forward with, preparation is the key. Read below to learn about a few tips on how to navigate a high asset divorce without the drama and a large attorney bill:
1. Legal Representation: Secure a skilled and experienced divorce attorney to guide you through the complexities, and most importantly an attorney that you trust.
2. Thorough Documentation: Document everything meticulously in writing, from finances to debts and communication about all settlement terms with your spouse.
3. Strategic Planning: Work closely with an attorney you trust to develop a strategic plan based on your specific circumstances and desired outcomes.
4. Children's Best Interest: If children are involved, prioritize their well-being and how to create the least restrict means of disruption for them. Document and plan each parent's involvement and commitment moving forward after the divorce.
5. Emotional Resilience: Expect emotional challenges and consider seeking support from therapists or support groups to cope and effectively navigate these issues. Remember your attorney is not your therapist.
6. Financial Preparation: Understand your financial situation thoroughly after the divorce for both parties involved. Plan for a property division that will be fair, just, and equitable so that no one feels depleted. If children are involved consider what the on-going life style will be like for the children in both households and do your best to determine a property division that will equalize the life styles between both households after the divorce for the children.
7. Open Communication Channels: Maintain open communication with your attorney and be transparent about all relevant details. Nothing is worse than leaving your attorney out of the loop during this process. An attorney you trust should be a resources and provide you with information and creative solutions that will allow you to make an informed decision and not drag out the litigation process to make more money.
Divorce can be stressful, even if it is not adversarial, so be sure you speak to an attorney about what your options are to minimize your stress during the divorce process.
