How Do I Save My Marriage?

In Texas, currently under the law, a spouse can file for divorce based on no-fault grounds, which is insupportability, i.e. the marriage is just not working out. 

This can be refreshing when you need to get out of a toxic marriage, but it can also be considered by some an easy way out when you don't want to work on your marriage when it is simply going through growing pains. 

Very few people get married with the idea that their marriage will fail one day and they will be going through a divorce in the future, but for some that's the reality. However, as a divorce attorney, I can admit that  sometimes parties find themselves rushing to divorce court when they just need to nurture their marriage back to health. 

To understand why it is important to be sure your marriage cannot be nurtured or saved before you file for divorce read below:

1. Why is divorce so hard and emotionally taxing?

Filing for a divorce is a lawsuit, and lawsuits in nature are emotionally taxing and difficult. Parties are under the scrutiny of the court on how to live their life, manage their finances, and interact with their children, and this can be very overwhelming especially if the divorce process is new to you.

 Filing for a divorce is also hard and emotional because it requires that you disclose private information such as bank statements, text messages, emails, pictures, and other information within strict deadlines. 

2. What are ways that I can try to save my marriage after I file for divorce?

First, have a conversation with your attorney about your decision to want to save your marriage. 

Second, speak to your spouse about how willing they are to put in the work to save your marriage. 

Three, seek the help of a professionals such as a counselor, coach, financial advisor, pastor or the likes to help you and your spouse navigate through this rough spot in your marriage. 

Fourth, stay committed and consistent to the process until the end. 

3. What do I do if I have tried to save my marriage, but it is not working?

First, consider hiring a professional for individual counselor or a life coach to ensure you work on yourself and begin the healing journey before you file for divorce.

Second, to the extent possible, have a conversation with your spouse about your plans and desires to file for divorce, and discuss the terms that you two can agree on so you can eliminate as much back and forth, litigation, and fees during the process. 

Third, hire an attorney that is in-line with your goals and journey. 

4. Can I stop the divorce process after I file?

Yes, you can stop the divorce process after it has been filed if you and the other party both agree to nonsuit the divorce case.  When you nonsuit the divorce case, the case is dismissed and the petition for divorce is no longer active. If you decide to file again the future, you'll have to start the divorce process over and pay the fees.
