The most important thing to my clients during their divorce case are their children and their money. Protecting your money will take strategy plan that is built around logic and reality and not emotions. Here are some factors to think about before filing for divorce:
Steps to Safeguard Finances:
- Compile an inventory of all assets and debts between you and your spouse so you can figure out what the community estate consist of for the court to divide.
- Open separate accounts for financial independence, especially if you are fearful that your spouse will drain an account or is not financially smart.
- Establish a post-divorce budget to have a realistic idea of what life will look like after a divorce, especially if you are going from a 2 income household to a 1 income household.
Legal Considerations:
- Identify marital vs. separate property because not all assets that you know of may mean community.
- Hire a forensic accountant if needed to trace and prove any separate property/commingling of assets.
- Review your credit report to be sure there are not accounts on your credit that you are not aware of.
- Address joint accounts or debts and determine if you will be closing them or keeping them open during the divorce process.
