Step-Parent Adoption

Step-parent adoption is a legal process where a step-parent becomes the legal parent of their spouse’s child. This process can strengthen family bonds.

1. Understand the Legal Requirements
Residency Requirements: Ensure you meet any residency requirements, which may dictate how long you or the child must have lived in the state before filing for adoption.
Marital Status: Texas law requires the step-parent to be legally married to the child’s biological parent.

2. Obtain Consent from the Non-Custodial Parent or Trial for Termination
Voluntary Consent: The non-custodial parent must voluntarily agree to terminate their parental rights.
Involuntary Termination: If the non-custodial parent is absent, has abandoned the child, or is deemed unfit or other factor the court can consider, the court may terminate their rights without consent.

3. File the Petition for Adoption
Legal Petition: File a petition for adoption with the family court in your jurisdiction.
Amicus Attorney: If the adoptee is a minor the court can require an amicus attorney to be appointed.

4. Home Study and Background Check
Home Study: A home study is conducted by a licensed social worker to evaluate the family’s living environment and dynamics.
Background Check: A criminal background check and child abuse registry check is required to ensure the step-parent is fit to adopt.

5. Court Hearing
Prepare for the Hearing: Be prepared to answer questions about your relationship with the child and why you believe adoption is in their best interest.
Legal Representation: Consider having an attorney represent you to navigate the legal complexities and present your case effectively.

6. Finalizing the Adoption
Adoption Decree: The judge issues an adoption decree, officially recognizing the step-parent as the child’s legal parent.
Amended Birth Certificate: Obtain a new birth certificate for the child, listing the step-parent as a legal parent.
